The Bureau of Industry and Security (BIS) is amending the Export Administration Regulations (EAR) by removing four persons, all under the destination of China, from the Unverified List (UVL) because BIS was able to verify their bona fides.
They are Chengde Oscillator Electronic Technology Co., China National Erzhong Group, Ningbo III Lasers Technology Co., Ltd., and Xinjiang East Hope New Energy Company Ltd., according to the US Federal Register document released on December 19.
Meanwhile, 13 Chinese entities were added to the UVL. Under the Biden Administration's policy direction, once a foreign government prevents a US official from conducting a site visit, the company will be placed on the UVL and, after 60 days, will move on to the more broadly restricted Entity List.
Once listed on the UVL, US companies must conduct additional due diligence before exporting to these companies, which not only serves as a warning but may also require both sides of the trade to apply for additional licenses.
The UVL is often used by the US government as a tool to prevent the export of sensitive US-made goods or technology to hostile countries. The US has also imposed comprehensive restrictions on China's exports of advanced semiconductor and chip manufacturing equipment to prevent China from using the technology or products for military upgrades.
According to Reuters, the US Department of Commerce has placed on the UVL all those companies that export control officials have been unable to complete a site visit to ensure that they can be trusted to receive US-origin technology or other goods.
